Cooperative Child Custody Evaluations

 


The Process:

Interview each parent and child individually. After the initial interviews it will be determined if it is necessary to interview collateral contacts (usually only required under special circumstances). After all interviews deemed necessary to the process are completed, the evaluator will issue written recommendations and meet with the parties (and their attorneys if desired) to negotiate a settlement and develop a Parenting Plan.

Is This Process Appropriate For My Situation?

This process is designed for parents and/or third parties who are involved in custody and visitation disputes where there are no allegations of serious abuse or severe substance abuse problems and the parties have not filed inflammatory declarations with the court.


How is a Cooperative Child Custody Evaluation different from mediation?

This process and mediation are similar in that the evaluator helps to guide the parties towards identifying the issues, finding points of compromise, and negotiation a settlement. However, in mediation, the mediator does not make recommendations. In the Cooperative Evaluation process, the evaluator makes recommendations and the work together to facilitate a settlement based on what is believed to be in the best interest of the children.

What Is The Purpose Of The Cooperative Child Custody Evaluation?

The purpose of the Cooperative Child Custody Evaluation is to encourage cooperation between the parties involved in a custody dispute to develop a workable Parenting Plan. This process is designed to keep children out of conflict and parents out of court. The issues of residential care and decision-making authority are addressed in a conciliatory environment with an emphasis on a timely resolution and the least disruption for the children.
